Job Description:
Cyberonics,a leading medical device company located in Houston, Texas is currently seeking to hire a Senior Intellectual Property attorney who enjoys developing anIP portfollio and has a passion for prosecution.


The Senior Intellectual Property Counsel is primarily responsible for managing the Company’s worldwide intellectual property procurement and maintenance programs, including US and foreign patent and trademark prosecution and maintenance. The secondary duties include ensuring proper IP labeling for existing and planned products, providing client counseling on a variety of intellectual property matters, providing support for licensing and freedom-to-operate efforts, and assisting in developing and executing mid-range and long-range intellectual property strategy.


· Develop and maintain technical expertise on the company’s existing VNS Therapy® System, planned future products, and related anatomy and physiology by regular, ongoing consultation with Company engineering, clinical, regulatory and manufacturing employees;

· Develop detailed expertise in the scope of the Company’s intellectual property portfolio, and future patent claiming and trademark strategies;

· Efficiently manage outside counsel in the drafting and prosecution of new and pending patent and trademark applications, and related filings;

· Manage a centralized patent docketing system and ensure that annuities and maintenance fees are paid in a timely manner;

· Update product IP labeling to maintain consistency with existing patent, trademark and copyright assets.

· Provide client counseling and support as needed for litigation, licensing, patent clearance, and IP strategy;

· Provide periodic reports to direct supervisor concerning the status and direction of intellectual property, including patents and trademarks; and

· Provide IP training for Company personnel to support the development and implementation of Company IP strategies.


· Bachelor of Science in engineering from an accredited university affording a thorough understanding of software and digital hardware design, strongly prefer preferably electrical/electronics, biomedical or chemical engineering.

· Juris Doctor or equivalent degree from an accredited law school;

· Must be licensed to practice law in at least one state in the United States, preferably in the State of Texas;

· Must be licensed as a Patent Attorney by the United States Patent and Trademark Office;

· Excellent patent prosecution skills, including a minimum of four (4) years of experience practicing law as a patent attorney active in patent prosecution work;

· Experience with patent docketing systems for managing patent prosecution workloads; and

· Excellent written, oral, listening, and organizational skills.


Experience practicing law in the legal department of a medical devices manufacturer is highly desirable;

· Experience in patent prosecution involving electrically powered implantable medical devices is desirable;

· Work experience as an electrical/electronics, biomedical, or chemical engineer is desirable; and

Experience in patent litigation is desirable.
