Job Description:

ViaCyte, Inc. is a preclinical therapeutic company focused on diabetes. Our therapy is based on pancreatic beta cell progenitors (Pro-Islet™) derived from human pluripotent stem cells. These cells are implanted using a durable and retrievable encapsulation device. Once implanted and matured, these cells secrete insulin in response to blood glucose levels. Our goal is long term insulin independence without immune suppression, and without hypoglycemia and other diabetes-related complications.

The Patent Agent or Attorney will assist with the administration of the Company’s intellectual property. Primary duties will include drafting and preparing patent and trademark applications, and assisting with all aspects of patent prosecution, including responses to office actions, appeals and interference proceedings. The Patent Agent or Attorney will also be relied upon to identify, review, and assess intellectual property strategies and risks, and recommend courses of action to maintain our competitive advantage. Developing and implementing freedom to operate strategies will be a main objective. Other critical functions include working with our scientific staff to capture and analyze ideas and preparing invention disclosures; and overseeing the Company’s intellectual property portfolio, specifically, the management of multiple patent counsel and firms. Additional responsibilities include monitoring and maintaining patent annuities and the patent docket, and tracking and managing the intellectual property budget and expenses. Assisting with drafting and reviewing patent license agreements, material transfer agreements, and general corporate or other contracts will be required, along with establishing and maintaining a practical system for archiving these documents in a central repository. Throughout all job activities, it is expected that the Patent Agent or Attorney will identify areas for optimization and implement process and procedural improvements.

This is a new position within our company and will report to our Intellectual Property Counsel/Director, Corporate Development.


The position of Patent Agent requires an advanced degree and a minimum of five years focused on the administration of intellectual property matters. Registration to practice before the US Patent and Trademark Office is preferred.

Candidates who possess a J.D. and four years of experience focused on the administration of intellectual property matters may be considered for the position of Patent Attorney, which would be filled as a part-time role in lieu of the Patent Agent. For the position of Patent Attorney, registration to practice before the USPTO is required, and a Ph.D. or other advanced degree is preferred.

For either role, a scientific background is required. Knowledge in the areas of stem cell, molecular, cell, or developmental biology and biochemistry is helpful. It is preferred that candidates possess experience with intellectual property in stem cell based technologies and with freedom to operate assessments or counseling. A license to practice law in California or another jurisdiction is preferred. Excellent verbal and written communication skills are required. Experience with general corporate and business contract matters is helpful.
